Rod Rosenstein to step down once attorney general is confirmed

The president's nominee for attorney general, William Barr, said Wednesday that he doesn't think special counsel Robert Mueller is on a "witch hunt", doesn't think he should be fired and is committed to making sure that Mueller finishes his investigation, according to Republican Sen.

Rosenstein had been overseeing the day-to-day operations of special counsel Robert Mueller's investigation into Russian meddling in the 2016 election and contacts with the Trump campaign.

Barr's nomination is likely to meet heavy scrutiny in light of the ongoing investigation, particularly from Democrats, following reports he had written a memo in June questioning the probe.

He said it took about "three seconds" for him to get the answer he was looking for concerning what Barr thinks of Mueller.

White House spokeswoman Sarah Huckabee Sanders told Fox News on Wednesday that Rosenstein had always planned to stick around two years.

Rosenstein became a frequent target of Trump's ire on Twitter - with the president recently re-posting an image of him and other officials behind bars.

She says he wants to help with the transition to a new attorney general.

Rosenstein's latest rumored departure was supposedly being timed for him to leave after the confirmation hearings for President Donald Trump's Attorney General nominee William Barr.

Barr asserted that the president had been acting within his executive branch of authority when he made the request and said Mueller "should not be permitted to demand that the president submit to interrogation about alleged obstruction". He has long overseen the investigation and has frequently drawn Trump's ire.

Barr submitted a memo to the Justice Department past year that argued the law doesn't support an inquiry into whether Trump may have obstructed justice if he tried to frustrate the Russian Federation investigation.

Senate Democratic leader Chuck Schumer said last month that Barr's memo should disqualify him from serving as attorney general.

He then handed off oversight to his deputy, putting Mr Rosenstein in the spotlight and leading to criticism from Republicans in Congress as well as Mr Trump.

Barr's Senate confirmation hearing begins January 15, which means a confirmation vote at the earliest would occur in mid-February.

Mr Rosenstein has spent his career at the Department of Justice, and most recently served for 12 years as the US Attorney General for the state of Maryland before beginning his current role in April 2017.
